This is a legally binding agreement made between BullionTraders SA (Pty) Ltd and you personally or if applicable on behalf of another individual for whom you are using the site for. By entering the website or creating a profile, you consent to have this agreement provided to you in electronic form. These terms and conditions apply to all purchases and sales, whether made through the website, by telephone, or otherwise. This User Agreement is effective on November 25th, 2020, for all users of this website. Because this agreement contains legal obligations, please read carefully before proceeding. BullionTraders SA (Pty) Ltd is doing business as (dba) BullionTraders and will be referred to as BullionTraders hereafter. Before you may place orders to purchase or sell with BullionTraders you must read and accept all of the terms and conditions in our user agreement. By using our website, you represent and warrant without limitation that you have read, understand, and agree to the terms of this agreement.
BullionTraders reserves the right to make any necessary changes to its terms and conditions at any given time without notification and that you agree that we may change the terms at any time. Also, you agree that we may make any changes to the website at our sole discretion, for any reason without providing notice to you. If you use our website after we have posted a change to the terms and conditions, then you have agreed to the new terms and conditions that are present by the most recent version of your terms and conditions.

By entering our website you acknowledge that you are the individual making all of your own decisions when purchasing or selling to BullionTraders and that we are not influencing or making recommendations as to how you conduct your sales or purchases with us. Also, by entering the site and purchasing or selling to BullionTraders you acknowledge that you are aware and assume all of the risks for which you have sole responsibility, associated with purchasing or selling precious metals and that BullionTraders is not liable or responsible for any of those risks.
Risks:
BullionTraders does not offer investment advice. We also do not guarantee profits on the items that you purchase. BullionTraders expresses no opinion on the soundness of any of your purchases. We do not offer recommendations as purchasing bullion and coins is speculative and unregulated and the contents of this website are just for reference use only and do not constitute the rendering of legal, financial, or investment advice.
Since investing in precious metals can be risky and the value or your bullion and coins can fluctuate drastically, you should understand all the risks associated with investing in bullion and coins and therefore make educated and knowledgeable decisions before buying from, or selling to BullionTraders.
Order Policies and Procedures:
Upon placing an order to buy or sell precious metals with BullionTraders you have entered into a binding and legally enforceable agreement. Availability and pricing are subject to change without notice.
Payment Options: BullionTraders requires that all payments be made by credit card, debit card, or EFT (bank wire). BullionTraders does not accept cash on delivery orders. BullionTraders reserves the right to cancel orders where payment is not dated within 24 hours for all EFT (bank wire) orders. In order to guarantee the price that you locked in, your payment must be received by BullionTraders within those 24 hours. In some instances, orders could be denied if payment is completed after the allotted time frame.
Chargeback Policy:
You agree not to file a credit card or debit card chargeback regarding any purchase and abide by the dispute resolution procedures listed. In the event that you breach this agreement and file a chargeback, upon a resolution in our favour of the chargeback by either the credit card issuing bank, the credit card processor or by VISA, MASTERCARD, you agree to reimburse us for any costs incurred in researching and responding to such chargeback, including without limitation, our actual costs paid to the credit card processor or our banks, other third parties, and the reasonable value of the time of our employees and owners spent on the matter, as determined in our discretion in good faith. You further agree that all dispute resolution procedures below will be deemed waived by you, and that these amounts will be added to the original amount of the order, and that this total amount will then be immediately due and payable. If your chargeback is upheld, you agree to pay all of the same costs, in addition to the original purchase price.
Cancellation Policy:
Due to the volatile nature of the bullion market, all gold, silver, platinum, and palladium bullion sales are final. The customer enters into a legally binding agreement once the order is submitted and confirmed, and may not cancel or modify their order afterward. If the customer still insists upon cancellation after the order is placed, a 10% penalty on orders WILL be collected. If the customer paid by card, a 10% fee will be charged to their source of payment and they will be refunded the other 90%.
Documentation:
BullionTraders reserves the right to request additional documentation for certain credit card orders or any other orders.
Cancellation of Orders:
BullionTraders expressly reserves the right to refuse or cancel any order, for any reason, at its sole discretion, regardless of the payment method and price confirmation.
Return Policy:
At BullionTraders we provide all of our customers with a refund, return or exchange policy on all the items that we sell. The right is limited to seven (5) days from the date on which the customer has received the products from us. You must notify BullionTraders Customer Service Department at sales@5.westernbuilds.co.za within seven (5) business days from the date that you receive the item and follow the instructions provided to you, at that time. Shipping and handling charges are non-refundable. You are fully responsible for all taxes, as well as return shipping and handling costs. The customer must make sure to carefully package and provide tracking information for the product that they are returning and the customer will assume the full cost of return shipping. BullionTraders may reject any returned or exchanged item that does not reasonably conform to these terms. In the case where a customer requests to exchange an item, BullionTraders expressly reserves the right in its sole and absolute discretion to find an acceptable replacement or refund your money should an acceptable replacement be unavailable. BullionTraders at its sole discretion, reserves the right to reject any returns or exchanges that do not comply with the requirements listed above. BullionTraders does charge 10% of the total purchase price as a restocking fee on all orders that are returned. Also, when returning bullion products, the customer may be required to pay additional market loss penalties on items returns at the discretion of BullionTraders. If market gains were to be incurred on a refund, those gains shall remain the property of BullionTraders.
Collections Expense:
In the event that BullionTraders has to take any action against a customer in order to enforce your obligations under this User Agreement, including, without limitation, turning your account over to a collection agency or a lawyer for collection, the customer shall have to pay all of the costs and the expenses incurred by BullionTraders including without limitation, reasonable attorney fees, in connection with such actions.
Free Shipping Policy:
The minimum order for free shipping is R20,000, any order under R20,000 will be charged a flat rate of R99.
Shipping: BullionTraders strives to protect your shipments by being discreet with our shipping labels and do not disclose or give any indication that contents inside the package contain valuable precious metals. When your items are shipped you will receive an email confirmation along with tracking information for your shipment.
We provide insurance for free on every package. Our insurance will only be covered if the item is lost or damaged in transit. We will not be responsible if the package tracking information shows as delivered. Once the item shows that it was delivered as promised as per our tracking information, we are no longer liable for our insurance policy and it is the customer’s responsibility at that point. When we ship the items to you, if the items are damaged or lost in transit, we will accept full responsibility and pursue any claims with our insurance policy. If an item is lost in transit we reserve the right at our own discretion to reship your item or provide you with a refund. Please note that BullionTraders will not be responsible for reimbursements or insurance claims on packages that are successfully delivered as addressed. Our liability and insurance cease the moment the package is signed for or left at the specified delivery address. We currently do not ship internationally. We only sell and ship to clients based within the borders of South Africa.
All prices quoted on our website are in South African Rands. While we work hard to ensure that all of our inventory and prices are current, discrepancies may occur at times due to product availability and changing market conditions, as well as typographical errors. Most of our products are bullion products which are constantly changing in price. As a result, the final prices of your items will be determined at the time of checkout where you will have 10 minutes to complete the checkout process or the prices will then readjust after that 10-minute interval has elapsed. We strive hard to assure the accuracy and information of the products and pricing that we provide on our site. However, pricing or typographical errors may occur at times and in the event that an item is priced improperly due to an error in pricing or information of the product. BullionTraders shall have the right at its sole discretion to cancel or refuse any orders placed on any item. We will notify you via email of such cancellation and do apologise if situations like this arise. In addition to the other rights and remedies available to BullionTraders, in the event of any failure by you to comply with this User Agreement, BullionTraders reserves the right to impose a charge including the credit card which you have provided to BullionTraders including, without limitation, any and all market losses incurred by BullionTraders including cancellation fees for accepting your orders to either buy from or sell to us as a result of price and market fluctuations for which you did not fulfil. You expressly authorize BullionTraders to charge your credit card for all of such amounts and to recover such amounts from you.
Account Settings and Password:
When you register and create a profile with BullionTraders, you will be asked to create a password that will be used to access our website to be able to purchase products. It is your responsibility to keep your username and password confidential and when registering, you are designating that you are solely responsible for all activities and transactions that occur under your username and password. Customers should use caution when accessing their account from a public or shared computer so that your password and personal information are not viewable to others. Make sure you fully exit from your account at the end of each session so that unauthorized use of your account is not breached. BullionTraders will not be liable for any damages or losses that may arise from your failure to comply with the provisions above.

Force Majeure:
If BullionTraders cannot perform any obligation hereunder as a result of any event that is reasonably beyond its control. BullionTraders’ delay or failure to perform such obligation shall be excused and BullionTraders shall not be liable for any damages as a result of, or in connection with, such delay or failure to complete the transaction.
Termination of Use:
BullionTraders reserves the right and sole discretion to suspend or terminate access to or part of its website at its discretion without any notice or reason. Once suspended or terminated from the use of our website, your right to use our site ceases immediately. BullionTraders will not be liable to the customer or any third party for any damages or claims arising from the termination or suspension of your account. Also, any fraudulent, illegal, or abusive activity may be referred to appropriate law enforcement authorities at our discretion.
Payment Method Options:
We accept numerous forms of payment methods. Please make sure to read and follow all the terms of your payment method of choice to ensure that all orders are handled accordingly.
Credit Cards:
Visa and MasterCard are accepted forms of payment and will be needed in order to lock in any transaction, including on wire transfers or check orders. The maximum credit card order accepted on this website is R20,000. We do not electronically store credit card information, for security reasons. Please be mindful that all credit card orders must have the same billing and shipping address to successfully place an order. If you’d like to have your package shipped to a different address, please process the order with the EFT/wire payment option.
Operation Hours:
Orders need to be placed during BullionTraders’ business hours (Monday-Friday, 9:00 AM-5:00 PM Eastern Time), excluding public holidays.
All EFT/wire transfers must be received within 24 hours of placing the transaction. The name of the account holder and recipient of the shipping address MUST match the name of the sender that initiated the EFT/wire transfer. If the name does not match, we may ask for additional information to verify your account.
Customers may be required to provide additional verification to confirm identity. When paying with VISA/ MASTERCARD, please make sure your billing address is the same as shipping address.
